Are Trailer Hitch Flag Poles Legal?

No. But there are guidelines for flying a flag on your truck or trailer that revolve around not inconveniencing your neighbors or fellow drivers. For instance, if your flag is too big and causes other drivers to be obstructed when driving, then you are pretty much committing a road traffic violation.

While most states do not have regulations regarding the mounting of flag poles on trucks, trailers, and other vehicles, obstruction the view of other drivers will get you flagged by traffic police. At the end of the day, you are responsible for maintaining the safety of other drivers with your actions.

The key things you need to consider are the placement of the flag and the size of the flag. Most flag poles are mounted at the rear end of the truck or trailer. Additionally, your flag should not flap onto your driver’s windshield.

The flag should also not drag on the ground or be offensive to other drivers. The display of controversial themed flags is unconstitutional. It should also be embellishment free lest they fly off the flag as you drive.

To ensure you do not violate any laws when flying your flag, you can follow the non-military vehicle guidelines;

  1. Your flag should not be mounted higher than the United States flag.
  2. The flag can be mounted on the roof, rear fender, or passenger side.
  3. The flag should not be half-staffed. It can be furled or secured with a black ribbon when going to a funeral.

Conclusion

The best trailer hitch flag pole should be weather resistant, compatible with most hitch receiver models, and be strong enough to keep your flag flying high. It should also be a one-man mounting and dismounting operation. Not to mention easy to store when it is not in use.
